1. Acceptance of Terms
The websites located at holidaylights.amyatx.com and holidaylights.abundancehomemtg.com (collectively, the “Site”) are operated by Contest Hosts Amy Johnston Harper (Compass Real Estate) and Nan Kirkpatrick (Abundance Home Mortgage LLC) (“Hosts,” “we,” “us,” or “our”). By accessing the Site, submitting a nomination, voting, or otherwise interacting with the Contest, you agree to these Terms, the Official Rules, and the Privacy Policy. If you do not agree, do not use the Site.
2. Eligibility & Contest Participation
Participation in Contest activities is subject to the Official Rules. Nominations are limited to single-family residences (including townhomes) located within the Great Hills neighborhood of Austin, Texas. Individuals must be at least 18 years old, or 13–17 with verified parent/guardian consent. We may require proof of eligibility at any time and may disqualify or remove content that violates these Terms or the Official Rules.
3. Accounts, Security & Verification
To nominate or vote, you may need to create an account by providing accurate contact information, completing security checks (such as hCaptcha), and verifying your email and/or phone number. You agree to maintain the confidentiality of your credentials and notify us promptly of any unauthorized access. We may suspend or terminate accounts that appear fraudulent, compromised, or inactive.
4. Acceptable Use
You agree not to:
- Use bots, scripts, or automated means to access, scrape, or submit data to the Site.
- Attempt to bypass fraud controls, device limits, or rate limits.
- Probe, scan, or test the vulnerability of any system or network.
- Upload or transmit viruses, malware, or other harmful code.
- Misrepresent your identity, impersonate others, or submit inaccurate information.
- Post or transmit unlawful, defamatory, obscene, harassing, hateful, or otherwise objectionable content.
We reserve the right to remove content, throttle usage, or block access for violations.
5. User Submissions & License
You retain ownership of your photos, descriptions, and other content submitted through the Site. By submitting content, you grant the Hosts and their affiliates a worldwide, royalty-free, sublicensable license to use, reproduce, modify, publish, and display that content for Contest administration, promotion, sponsor recaps, and archival purposes in any media now known or later developed. You represent that you have the rights and permissions needed to grant this license and that your content does not infringe others’ rights.
6. Site Intellectual Property
The Site (including text, graphics, logos, design elements, software, and databases) is owned by the Hosts or their licensors and protected by intellectual property laws. Except as expressly permitted by these Terms or the Official Rules, you may not copy, distribute, modify, reverse engineer, or create derivative works from the Site. You may download or print materials for personal, non-commercial Contest participation only.
7. Privacy
Your use of the Site is subject to our Privacy Policy, which describes how we collect, use, and share information. By using the Site, you consent to the practices outlined there.
8. Disclaimers
The Site and Contest are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Site will be uninterrupted, error-free, secure, or that defects will be corrected.
9. Limitation of Liability
To the fullest extent permitted by law, the Hosts and their volunteers, partners, sponsors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your use of the Site or participation in the Contest. Our total liability for any claim is limited to the amount, if any, that you paid to participate in the Contest (which is zero dollars).
10. Indemnification
You agree to defend, indemnify, and hold harmless the Hosts, their affiliates, sponsors, and service providers from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, your submissions, or your misuse of the Site.
11. Third-Party Services & Links
The Site may contain links to third-party websites, services, or sponsor pages. We do not control and are not responsible for their content, products, or services. Access third-party sites at your own risk and review their terms and policies.
12. Changes to These Terms
We may update these Terms periodically. When changes are made, we will revise the “Last updated” date below and, if changes are material, provide additional notice on the Site. Continued use of the Site after changes become effective constitutes acceptance of the revised Terms.
13. Governing Law & Venue
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Subject to Section 14, any legal action must be brought in the state or federal courts located in Travis County, Texas, and you consent to their jurisdiction.
14. Dispute Resolution & Arbitration
Any dispute or claim arising out of or relating to the Contest, the Site, or these Terms shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, governed by the Federal Arbitration Act. The seat of arbitration is Travis County, Texas. Proceedings must be conducted on an individual basis; class, consolidated, or representative actions are not permitted. The Hosts may seek injunctive relief or the protection of intellectual property/confidential information in a court of competent jurisdiction.
15. Severability & Waiver
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect. Failure to enforce any provision does not constitute a waiver of that provision.
